Travel Terms and Disclosures

These Travel Terms and Disclosures ("Terms") govern the relationship between Crosswind Travel ("Agency," "we," "us," or "our") and clients who engage our travel advisory and planning services. By engaging our services or booking travel arrangements through Crosswind Travel, you acknowledge that you have read, understood, and agreed to these Terms.

1. Role of Crosswind Travel
Crosswind Travel acts solely as an independent travel advisor and intermediary between clients and third-party travel suppliers. These suppliers may include cruise lines, airlines, hotels, resorts, tour operators, transportation companies, and travel insurance providers.

Crosswind Travel does not own, operate, or control any travel supplier. All travel services are provided directly by the respective supplier and are subject to the supplier’s own terms and conditions.

2. Travel Planning Fees
Crosswind Travel may charge professional planning or consultation fees for certain travel services. These fees compensate the agency for research, itinerary design, consultation time, and travel coordination services.

Planning fees are non-refundable unless otherwise stated in writing.

3. Pricing and Availability
Travel pricing and availability are subject to change until confirmed with a deposit or full payment. Suppliers may adjust pricing, availability, taxes, and fees at any time prior to booking confirmation.

Crosswind Travel is not responsible for pricing changes or availability fluctuations imposed by travel suppliers.

4. Deposits and Final Payments
Deposits and payment schedules are determined by the individual travel supplier. Clients are responsible for submitting all required payments by the deadlines established by the supplier.

Failure to make payments by the required deadlines may result in cancellation of reservations and forfeiture of deposits.

5. Cancellations and Refunds
Cancellation policies are determined by the individual travel supplier. Refund eligibility, if any, will be subject to the supplier’s terms and conditions.

Crosswind Travel is not responsible for supplier cancellation penalties or fees.

Planning fees and service fees charged by Crosswind Travel are generally non-refundable.

6. Travel Insurance
Travel insurance is strongly recommended for all travelers. Insurance may provide coverage for trip cancellations, travel interruptions, medical emergencies, and other unforeseen events.

If you decline travel insurance coverage, you acknowledge that you assume full financial responsibility for any cancellations, delays, or unforeseen travel disruptions.

7. Travel Documents
Travelers are solely responsible for ensuring they possess valid travel documentation, including passports, visas, vaccination records, and any other entry requirements required by their destination.

Crosswind Travel is not responsible for denied boarding, entry refusals, or travel disruptions caused by incomplete or invalid documentation.

8. Supplier Changes
Travel suppliers may modify or cancel itineraries, schedules, accommodations, or services due to operational needs, weather conditions, mechanical issues, government actions, or other circumstances beyond their control.

Crosswind Travel is not responsible for supplier changes or disruptions and shall not be liable for any resulting losses or expenses.

9. Force Majeure
Crosswind Travel shall not be liable for failure or delay in performing services due to events beyond its control, including but not limited to acts of God, natural disasters, pandemics, government actions, strikes, war, civil unrest, airline disruptions, or supplier bankruptcy.

10. Limitation of Liability
To the fullest extent permitted by law, Crosswind Travel shall not be liable for any injury, loss, damage, delay, inconvenience, or expense arising from travel services provided by third-party suppliers.

This limitation includes, but is not limited to, personal injury, property damage, delays, cancellations, or travel interruptions caused by suppliers or circumstances beyond the agency’s control.

11. Client Responsibility
Clients are responsible for reviewing all travel documents, itineraries, invoices, and confirmations for accuracy. Any discrepancies should be reported promptly.

Clients are also responsible for complying with all airline, cruise line, hotel, and destination regulations and requirements.

12. Chargebacks
Clients agree not to initiate chargebacks or payment disputes for services that have been delivered in accordance with agreed-upon terms.

Chargebacks initiated without proper justification may result in collection action and recovery of associated costs.

13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas.
